This decision angered the City of Chicago,which subsequently sued Smollettfor police overtime and court costs.
Smolletts legal team has released a statement condemning the decision to pursue new charges.
In return, the actoris also still pursuinghis malicious prosecution counterclaim against the city.
Smollett is ordered to return to court on March 18.
